ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND MEDIA RELEASE AGREEMENT

1. ASSUMPTION OF RISK

I understand that participation in activities organized by Boise Run Club (collectively “BRC”) involves inherent risks including but not limited to:

  • Running-related injuries (sprains, fractures, tendon injuries, overuse injuries)

  • Cardiovascular events including heart attack or stroke

  • Heat illness, dehydration, hypothermia

  • Slips, falls, and collisions

  • Traffic-related hazards

  • Trail and uneven surface hazards

  • Wildlife encounters

  • Negligent acts of other participants

  • Acts of nature and weather conditions

I voluntarily assume all risks associated with participation, whether known or unknown.

2. RELEASE OF LIABILITY

In consideration for being permitted to participate, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE:

Boise Run Club, their owners, officers, volunteers, coaches, sponsors, partners, and affiliates (collectively “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me while participating in BRC activities, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.

This release does not apply to gross negligence or intentional misconduct.

3. MEDICAL ACKNOWLEDGMENT

I certify that:

  • I am physically fit and sufficiently trained to participate.

  • I have not been advised otherwise by a qualified medical professional.

  • I understand that I am responsible for my own medical expenses.

  • I carry my own health insurance coverage.

I authorize BRC to obtain emergency medical treatment for me if necessary and agree to be responsible for all related costs.

4. INDEMNIFICATION

I agree to indemnify and hold harmless the Released Parties from any claims, liabilities, damages, or expenses (including attorney’s fees) arising from my participation or my actions during BRC activities.

5. MEDIA RELEASE

I grant Boise Run Club the irrevocable right and permission to:

  • Photograph, film, or record me

  • Use my image, likeness, voice, and name

  • Publish or distribute media in print, digital, social media, advertising, and promotional materials

  • Share media with sponsors and brand partners

I understand:

  • I will receive no compensation.

  • Media may be edited.

  • Rights granted are perpetual and worldwide.

  • I waive any right to inspect or approve final media.

6. CODE OF CONDUCT

I agree to:

  • Follow all safety instructions

  • Obey traffic laws

  • Act responsibly and respectfully

  • Not run under the influence of drugs or alcohol

  • Accept personal responsibility for pacing and effort level

BRC reserves the right to remove participants for unsafe or disruptive behavior.

7. GOVERNING LAW

This Agreement shall be governed by the laws of the State of Idaho.

Any legal action shall be brought in Ada County, Idaho.

8. SEVERABILITY

If any provision of this Agreement is held invalid, the remaining provisions shall remain in full force and effect.

9. ACKNOWLEDGMENT OF UNDERSTANDING

BY FILLING OUT AND SUBMITTING YOUR INFORMATION BELOW, YOU ACKNOWLEDGE THAT YOU UNDERSTAND AND AGREE TO THE ASSUMPTION OF RISK, RELEASE OF LIABILITY, MEDIA RELEASE, AND ALL OTHER ITEMS DESCRIBED ABOVE.
